The Ecuadorian constitution grants foreigners identical property rights to Ecuadorian citizens. There is no maritime zone concession regime. The only specific restriction applies within 50 km of international land borders, where additional approvals may be required. Everywhere else — coast, highlands, jungle — you purchase direct titled property. Once your offer is accepted, both parties sign a legally binding Promise of Sale establishing the price, deadlines, and penalties.
The buyer pays a deposit of 10 %–20 % directly to the seller or their lawyer. If something goes wrong, recovering that money means a long and costly civil lawsuit.
You sign the agreement digitally and wire the earnest money to the account of a licensed escrow agent in the United States — never to the seller. The money does not move until the notary attests that the deed was signed. You have a 48-hour cooling-off period after depositing; the platform's 1 % technology fee applies to the deposit only, not to the price.
Before signing the final deed, the property must undergo a rigorous review at the municipality and the Property Registry.
You hire a local attorney to request the Certificate of Encumbrances (a 15-year title history proving there are no mortgages, liens, or sale restrictions) and verify that there are no outstanding municipal property-tax debts.
The platform assigns a verified notary to your transaction. Over 15 days (extendable) the notary reviews the Certificate of Encumbrances, the cadastral and municipal no-debt certificates and the seller's tax status. Refund Policy: if a material legal defect appears — a hidden lien, an unresolved inheritance — that the seller cannot cure, your deposit is returned in full, less the direct cost of the notary's investigation. If you withdraw without cause, the penalty is capped at 5 % of the price.
In Ecuador, ownership transfer is only valid when carried out through a Public Deed executed before a licensed Notary.
The Notary drafts the deed incorporating proof of payment of the Alcabala and the seller's municipal capital-gains tax. Buyers abroad must arrange their own Power of Attorney and trust that the seller's representatives are acting in their interest.
If you are purchasing from abroad, BuyEnjoy coordinates the Special Power of Attorney (usually granted at an Ecuadorian consulate in your country) so your representative signs on your behalf. The escrow agent releases the funds to the seller only against the notary's attestation that the deed was signed and the disbursement instruction both parties sign on the platform. The purchase is not officially yours until the Public Deed is registered with the Property Registry of the relevant canton. Each canton runs its own registry, so timing varies.
Taxes and fees usually total 1.5 %–2.5 % of the price: Alcabala (~1 % to the municipality), the cantonal registry fees and the notary's fees by schedule. Tracking registration status requires repeated in-person visits.
